1. Agreement To These Terms
These Terms of Use (the "Terms") form a binding agreement between you and SideBet Golf, LLC, a Florida limited liability company ("SideBet Golf," "we," "us," or "our"), concerning your access to and use of the SideBet Golf websites, applications, and related services (collectively, the "Service"). By creating an account, selecting the agreement checkbox, or using the Service after accepting these Terms, you agree to these Terms and the Acceptable Use Policy and acknowledge the Privacy Policy. If you do not agree, do not create an account or use the Service.
2. Eligibility And Accounts
You must be at least 18 years old and legally capable of entering into this agreement. You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account unless applicable law provides otherwise. Accounts may not be sold, transferred, shared between unrelated people, or created using false identities.
3. What The Service Does
The Service helps users organize golf events, maintain player and course information, record scores, calculate standings and handicaps, track event-defined side games, and prepare informational payout or settlement summaries. Organizers and participants control their events, rules, entries, scores, side-game selections, and any arrangements made outside the Service.
Subscription and event-purchase fees compensate SideBet Golf only for access to software and related services. They are not wagers, entry stakes, contributions to a prize pool, or consideration for gambling activity. SideBet Golf subscription pricing does not depend on the amount wagered, won, lost, or displayed by users.
4. Side Games, Pools, And Calcuttas
The Service may allow users to enter dollar-denominated stakes, auction prices, ownership shares, prize allocations, side-game rules, and calculated results. These fields are private recordkeeping and mathematical tools for arrangements independently established by users. Displaying an amount does not mean that SideBet Golf accepted a wager, received money, guaranteed payment, determined legality, or created an enforceable debt.
SideBet Golf does not solicit or accept wagers; set odds; act as the house; match members of the public for betting; buy, sell, or own an interest in a participant; conduct an auction; extend credit; hold deposits or prize pools; collect losses; distribute winnings; transmit settlement funds; or resolve collection disputes. Any friendly wager, pool, auction, Calcutta, or similar arrangement is organized and conducted solely by the users involved, outside the Service.
You may use monetary side-game features only for a private arrangement among consenting adults and only where the arrangement and your use of the Service are lawful. You are solely responsible for determining and complying with all laws, club rules, tournament rules, tax obligations, reporting requirements, and other restrictions that apply to you, your event, and every participant's location. Availability of a feature is not a representation that its use is lawful in any jurisdiction.
5. No Payment Or Collection Services
SideBet Golf does not receive, safeguard, process, route, transfer, or settle money associated with user side games. Users must not send wager funds to SideBet Golf or represent that SideBet Golf is holding or guaranteeing funds. Any payment or settlement occurs independently between users, at their own risk and subject to applicable law. SideBet Golf will not enforce, collect, purchase, or adjudicate a claimed gambling debt.
6. Organizer Responsibilities
An organizer is responsible for obtaining participant consent, communicating event and side-game rules, controlling administrative access, confirming player eligibility, protecting invite and spectator links, entering accurate information, reviewing calculations, correcting errors, and maintaining any records required outside the Service. Organizers must not describe SideBet Golf as the sponsor, operator, stakeholder, cashier, escrow agent, or guarantor of an event or side game.
7. Scores, Handicaps, And Calculations
The Service relies on user submissions, third-party course information, handicap inputs, event settings, and automated calculations. Mistakes, incomplete data, connectivity failures, and conflicting rules can occur. All scores, handicaps, standings, tiebreakers, side-game outcomes, and payout summaries must be reviewed by the organizer and affected participants before they are treated as final or used for an external settlement. SideBet Golf is not responsible for losses or disputes caused by incorrect data or an unverified calculation.
8. Purchases And Subscriptions
Prices, billing periods, included features, renewal terms, and cancellation options are presented at purchase. You authorize charges you approve through the designated subscription payment method. Except where required by law or expressly stated at purchase, fees for completed billing periods and activated single-event products are nonrefundable. We may change future pricing or plan features after providing notice required by law; changes will not retroactively alter a completed purchase.
9. User Content And Event Data
You retain ownership of information and content you submit. You grant SideBet Golf a nonexclusive, worldwide, royalty-free license to host, process, reproduce, and display that material only as reasonably necessary to operate, secure, support, and improve the Service. You represent that you have authority to provide the information and to invite or communicate with the people included in an event. Do not upload confidential, infringing, unlawful, or unnecessarily sensitive information.
10. Acceptable Use
You must follow the Acceptable Use Policy, which is incorporated into these Terms. Among other restrictions, you may not use the Service to operate a bookmaking or commercial gambling business, take a fee or percentage tied to user wagers through the Service, facilitate wagering involving minors, deceive participants, manipulate results, harass others, expose personal information, or interfere with the Service's security or operation.
11. Third-Party Services And Information
The Service may contain course data, maps, handicap information, rules references, links, or integrations supplied by third parties. Third-party products and websites are governed by their own terms and policies. We do not control and are not responsible for third-party availability, accuracy, security, content, or conduct. References to golf rules or handicap systems are informational and do not constitute an official ruling.
12. SideBet Golf Intellectual Property
The Service, software, visual design, trademarks, logos, documentation, and original content are owned by SideBet Golf or its licensors and are protected by applicable law. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Service for its intended purposes. You may not copy, resell, sublicense, reverse engineer, scrape, or exploit the Service except as expressly permitted by law or written authorization.
13. Service Changes And Availability
We may add, change, suspend, or discontinue features and may perform maintenance without guaranteeing uninterrupted availability. Mobile service, device storage, browser behavior, third-party systems, and golf-course connectivity are outside our control. Offline safeguards reduce risk but do not guarantee that every score or submission will be preserved or synchronized. Keep a reasonable backup method for important events.
14. Disclaimer Of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available." SideBet Golf disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted availability, accuracy, and legal suitability. We do not warrant that an event, side game, pool, Calcutta, settlement, or other user activity complies with any law or rule.
15. Limitation Of Liability
To the maximum extent permitted by law, SideBet Golf and its members, managers, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, goodwill, data, or opportunities; wager, pool, auction, prize, or settlement losses; disputes between users; personal injury or property damage arising from an event; or unauthorized access caused by a user's failure to protect credentials.
To the maximum extent permitted by law, SideBet Golf's aggregate liability arising from the Service will not exceed the greater of the amount you paid directly to SideBet Golf during the 12 months before the event giving rise to the claim or $100. Some jurisdictions do not allow particular exclusions or limitations, so portions of this section may not apply to you.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SideBet Golf and its members, managers, officers, employees, contractors, and service providers from claims, losses, liabilities, penalties, and reasonable costs arising from your event, content, side games, pools, auctions, Calcuttas, external payments, violation of law, violation of these Terms, or infringement of another person's rights. This obligation does not apply to the extent a claim was caused by SideBet Golf's own unlawful conduct.
17. Suspension And Termination
We may restrict or terminate access when reasonably necessary to protect users or the Service, investigate suspected misuse, comply with law, address nonpayment, or enforce these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limitations, indemnification, and dispute terms, will survive.
18. Governing Law, Informal Resolution, And Arbitration
Please read this section carefully. It requires most disputes to be resolved through binding individual arbitration, waives jury trials, and prohibits class and representative proceedings unless you timely opt out as described below.
Governing law. These Terms are governed by Florida law, without regard to conflict-of-law principles, except where the Federal Arbitration Act or other mandatory law controls. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement in this section.
Informal resolution first. Before starting arbitration or a permitted court proceeding, the claimant must email support@sidebetgolf.app with the claimant's name, account email, a description of the dispute and supporting facts, and the requested relief. The parties will attempt in good faith to resolve the dispute for 30 days after receipt of a complete notice. Any applicable limitations period will be tolled during that 30-day period to the extent permitted by law.
Binding individual arbitration. Except for the exceptions below, any dispute, claim, or controversy arising out of or relating to these Terms, the Acceptable Use Policy, the Service, or the relationship between you and SideBet Golf will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect when the claim is filed. The arbitrator may award any individual remedy available in court under applicable law, and judgment on the award may be entered in any court with jurisdiction. Information about the AAA and its Consumer Arbitration Rules is available at adr.org.
Remote proceedings and venue. Arbitration hearings will be conducted by video or telephone unless the parties agree otherwise or the arbitrator determines that an in-person hearing is necessary. To the fullest extent permitted by the AAA rules and applicable law, the arbitration situs is Brevard County, Florida. A consumer will not be required to travel to Brevard County when the AAA rules or applicable law require an in-person hearing at a location reasonably convenient to the consumer. Exclusive venue for any permitted court proceeding is the state courts located in Brevard County, Florida, or, if federal jurisdiction exists, the federal court whose district includes Brevard County, except where nonwaivable law requires otherwise.
Exceptions. Either party may bring an individual claim in small claims court if it qualifies and remains there. Either party may seek temporary or emergency injunctive relief from a court to prevent unauthorized access, misuse, or infringement while arbitration is pending. Nothing in these Terms prevents anyone from reporting a concern to, cooperating with, or seeking relief from a government agency, regulator, or law-enforcement authority where that right cannot lawfully be restricted.
Individual proceedings only. You and SideBet Golf agree that each may bring claims only in an individual capacity and not as a plaintiff, claimant, or class member in a class, collective, consolidated, coordinated, mass, or representative proceeding. The arbitrator may not combine claims or preside over a nonindividual proceeding without every affected party's written consent. If this waiver is finally determined to be unenforceable for a particular claim or requested remedy, only that claim or remedy will proceed in court, and the remaining arbitrable matters will remain in individual arbitration to the extent permitted by law.
Fees and costs. Arbitration filing fees, administrative fees, and arbitrator compensation will be allocated under the AAA Consumer Arbitration Rules and applicable law. To the fullest extent permitted by applicable law, the prevailing party in a permitted court proceeding to enforce this agreement or to confirm, modify, or vacate an arbitration award is entitled to recover reasonable attorneys' fees and associated costs. In arbitration, the arbitrator may award reasonable attorneys' fees and costs only when authorized by applicable law. No consumer will be required to pay fees or costs that applicable law or the AAA Consumer Arbitration Rules prohibit shifting.
Thirty-day opt-out. You may opt out of this arbitration agreement by emailing support@sidebetgolf.app within 30 days after you first accept Version 2026-08-26 of these Terms. Your notice must include your full name, the email address associated with your account, and an unambiguous statement that you opt out of the SideBet Golf arbitration agreement. Opting out will not affect the remaining Terms or your account. This section does not apply to a dispute for which either party sent a written dispute notice before August 26, 2026.
19. Changes To These Terms
We may update these Terms as the Service changes. The effective date and version identify the current document. If a change is material, we may provide notice and require renewed acceptance. Continued use after the effective date of a nonmaterial update constitutes acceptance where permitted by law.
20. General Terms
These Terms and the Acceptable Use Policy are the entire agreement concerning the Service unless a separate written agreement expressly applies. If one provision is unenforceable, the remainder remains in effect. A failure to enforce a provision is not a waiver. You may not assign this agreement without our consent; we may assign it as part of a reorganization, financing, merger, acquisition, or transfer of the Service.
